Terms of Service
Effective October 23, 2026
These Terms of Service ("Terms") govern the use of the EnrollPilot AI admissions assistant and related services (the "Service") and the website enrollpilotai.com. They form an agreement between EnrollPilot AI ("we", "us") and the school or organization that subscribes to the Service ("School", "you"). A signed order form or proposal, if any, takes precedence over these Terms where they conflict.
1. The Service
The Service is an AI assistant that answers prospective students on the School's website chat and WhatsApp, using content the School approves. It answers questions, qualifies prospects, books appointments, sends reminders and hands conversations to the School's staff. Features available to you depend on your plan.
2. Accounts
You are responsible for the people you give access to, for keeping login credentials secure, and for all activity under your account. Tell us promptly at admin@enrollpilotai.com if you suspect unauthorized access.
3. Plans, fees and billing
- Onboarding. A one-time onboarding fee applies unless waived in writing.
- Subscription. Plans are billed monthly in advance, or yearly in advance for annual plans, at the prices on our website or in your order form. Prices are in US dollars and exclude taxes.
- Inquiries. Each plan includes a number of new inquiries per month. An inquiry is one prospective student, however many messages they send. If you go over your limit, we charge the published per-inquiry overage or move you to the next plan, whichever costs less. We do not cut off the Service mid-month.
- Pass-through costs. WhatsApp and carrier messaging fees, if any, are passed through at cost.
- Late payment. If an invoice is more than 15 days overdue, we may suspend the Service after giving you notice.
- Price changes. We will give you at least 30 days' notice before a price change takes effect for your account.
4. Term and cancellation
After onboarding, the Service runs month to month, or for the prepaid term of an annual plan. Either party can cancel with 30 days' written notice. Fees already paid are not refunded, except where the law requires it. We may suspend or end the Service immediately if you materially breach these Terms or use the Service unlawfully. Sections 8, 11, 12, 13, 14 and 15 survive termination.
5. Your responsibilities
- Accurate content. You are responsible for the accuracy, completeness and approval of the content the assistant uses, including programs, costs, start dates, financial aid information and outcomes data, and for keeping it current.
- Regulatory compliance. You remain responsible for complying with the laws and rules that apply to your school, including Department of Education rules on misrepresentation and incentive compensation, state authorization requirements and your accreditor's standards.
- Review. You will review and approve the assistant's content before going live and can review conversations at any time.
- Your privacy notice. You will maintain a privacy policy that tells prospective students how their information is used.
6. Messaging and consent
You are responsible for having a lawful basis and any required consent to message each prospective student, including under the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act and the WhatsApp Business policies. The assistant replies to prospects who contact you and honors opt-out requests such as STOP. You will not use the Service to send unsolicited messages or to contact anyone who has opted out.
7. AI-generated replies
The assistant generates replies with AI models, working from the content you approve. AI can make mistakes. The assistant is instructed not to promise financial aid eligibility, award amounts, admission, employment or salaries, and to hand questions it cannot answer to your staff. You agree that the assistant is a tool to support your admissions team, not a replacement for its judgment, and that final admissions and financial aid decisions are made by your staff.
8. Your data
You own your content and the conversations with your prospective students ("School Data"). You give us permission to use School Data only to provide, secure, support and improve the Service for you, as described in our Privacy Policy. We do not sell School Data. When the Service ends, we will export your conversation history to you on request and then delete School Data from our systems, except where the law requires us to keep it. We may use aggregated, de-identified statistics that do not identify you or any person.
9. Acceptable use
You will not: use the Service for any unlawful, deceptive or harassing purpose; make false or misleading claims through it; collect Social Security numbers, financial account numbers or other sensitive data through the chat; try to break, overload or reverse engineer the Service; or resell it without our written permission.
10. Third-party services
The Service relies on third parties, including messaging platforms such as WhatsApp, AI model providers and hosting providers. Their availability and policies may change, and we are not responsible for their acts or outages. If a third party changes or ends a service the Service depends on, we will make reasonable efforts to provide an alternative.
11. Intellectual property
We own the Service, its software and the EnrollPilot AI name and brand. These Terms do not give you any rights to them beyond using the Service during your subscription. If you send us feedback, we may use it without obligation to you. We may use your school's name or a case study only with your written permission.
12. Disclaimers
We will provide the Service with reasonable care and skill. Other than that, the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any number of inquiries, appointments, enrollments or revenue. Figures shown on our website are estimates or illustrations.
13. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Each party's total liability under these Terms is limited to the fees you paid us in the 12 months before the event that caused the claim. These limits do not apply to your payment obligations or to either party's indemnification obligations.
14. Indemnification
You will defend and indemnify us against third-party claims arising from your content, your messaging to prospective students, or your breach of Sections 5, 6 or 9. We will defend and indemnify you against third-party claims that the Service, as we provide it, infringes their intellectual property rights.
15. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. The state and federal courts located in Cameron County, Texas have exclusive jurisdiction over any dispute, and both parties consent to that venue.
16. Changes and contact
We may update these Terms. We will post the new version on this page and notify Schools at least 30 days before material changes take effect. Continuing to use the Service after that date means you accept the updated Terms.
